What Are the Penalties for Growing Marijuana in Washington?

A conviction could mean up to 5 years behind bars and $10,000 in fines. Even though Initiative 502 (I-502) allows adults age 21 and over to legally possess up to 1 ounce of marijuana for recreational use, unless you are an authorized medical marijuana patient under state law or obtain a producers license, growing marijuana remains a crime. Growing marijuana can cause you to be jailed or sent to prison, and face substantial fines. There are many ways a person could be caught in the criminal justice system for growing marijuana, and if this has happened to you, the need for a quality defense cannot be overstated.

How You Can Legally Grow or Manufacture Marijuana in Washington

In order to grow or manufacture marijuana in Kitsap County, you must obtain a medical exception, be a designated caregiver or obtain a producer's license. In order to be exempted from being charged with a crime, you must obtain a written recommendation from a physician, register with the state, and obtain registry identification you may designate a primary caregiver to help you grow up to 15 marijuana plants. If you possess larger quantities of marijuana than the amount that you are eligible to grow, you will still be exempt from criminal charges if you present evidence indicating that you require higher quantities to adequately treat your medical condition.
