Communication with a Minor for Immoral Purposes (CMIP): Legal Definition  

RCW 9.68A.090 addresses criminal communication with a minor for immoral purposes under Washington state law. The statute prohibits communication with a person under the age of 18 for the purpose of engaging in, promoting, or facilitating any activity that qualifies as a commercial sex act or sexually explicit conduct as defined by state law.

The offense can be charged as either a gross misdemeanor or a Class C felony, depending on the specific circumstances. The felony classification applies if the defendant has prior convictions for this or similar offenses, or if they communicate with a minor (or someone they believe to be a minor) through electronic means such as text messages, social media, or email.

In Washington, a gross misdemeanor is punishable by no more than a year in jail and/or a fine of up to $5,000. A Class C felony conviction carries a penalty of five years of imprisonment and/or a fine of $20,000.  

It is important to understand that this statute covers both direct and indirect communications. The law applies whether the defendant is communicating with an actual minor or someone they believe to be a minor, such as in cases involving law enforcement sting operations. The statute also encompasses communications made through a third party when the intent is to reach a minor.
